Terms of Use

JC Learning is operated by JC Human Resources Limited.

1. Introduction
1.1 Welcome to JC Learning (“the Platform”). By accessing or using our website (www.jchrhk.com), courses, or related services, you agree to be bound by these Terms of Use (“Terms”).
1.2 If you do not agree to these Terms, please do not use the Platform.
1.3 These Terms apply to all users, including learners, Providers, and visitors.
1.4 Capitalised terms not defined in these Terms have the meanings given in the Glossary of Defined Terms available on our website.

2. Definitions
2.1 “JC Learning”, “we”, “our”, or “us” means JC Human Resources Limited, operator of the Platform.
2.2 “User”, “you”, or “your” means any individual or entity accessing or using the Platform.
2.3 “Provider” means an individual or organisation approved to deliver content under the Master Provider Agreement.
2.4 “Course” or “Programme” means any CPD session, training, or learning material available on the Platform.

3. Acceptance of Terms
3.1 By using JC Learning, you confirm that you are at least 18 years old or using the Platform under parental or guardian supervision.
3.2 You agree to comply with all applicable laws and regulations of the Hong Kong Special Administrative Region (HKSAR).

4. Account Registration
4.1 You may need to create an account to access certain services.
4.2 You agree to provide accurate, current, and complete information and maintain the confidentiality of your credentials.
4.3 You are responsible for all activities conducted under your account.

5. Course Purchase and Access
5.1 All course purchases are subject to JC Learning’s Refunds & Cancellations Policy.
5.2 You are granted a limited, non-transferable licence to access purchased content for personal learning purposes only.
5.3 JC Learning may update, modify, or remove content at its discretion.
5.4 Access periods are specified per course; expired access cannot be extended without a new purchase.

6. Data Sharing with Providers
6.1 When you register for or enrol in a course, you consent to JC Learning sharing limited personal data with the relevant Provider. Such data may include your name, email address, enrolment status, attendance information, and participation data.
6.2 This data is shared solely for purposes directly related to course delivery, including attendance verification, learning support, and certificate issuance (where applicable).
6.3 All Providers are contractually bound by the Master Provider Agreement and the Data Protection Notice (Providers). Providers must handle participant data securely, use it only for the purposes described in Clause 6.2, and comply with the Personal Data (Privacy) Ordinance (Cap. 486).
6.4 Providers are strictly prohibited from using participant data for marketing, promotional, or unrelated purposes unless the participant has given separate, express consent.


7. Intellectual Property
7.1 All content (text, images, videos, software, and other materials) on the Platform is owned or licensed by JC Human Resources Limited and its Providers.
7.2 You may not copy, distribute, reproduce, or create derivative works from any material without written consent.
7.3 Providers retain ownership of their submitted content but grant JC Learning a limited licence for hosting, marketing, and delivery purposes.

8. User Conduct & Acceptable Use
8.1 You agree not to:
 (a) Upload, share, or transmit any unlawful, defamatory, or infringing material;
 (b) Attempt to gain unauthorised access to the Platform or its systems;
 (c) Share course access credentials or materials without permission;
 (d) Engage in cheating, plagiarism, or misrepresentation in assessments;
 (e) Interfere with the normal operation of the Platform.
8.2 Violation of this clause may result in suspension, certificate revocation, or permanent account termination.

9. Provider Content
9.1 Providers are governed by the Master Provider Agreement.
9.2 All Provider-submitted materials must comply with JC Learning’s Content Standards & Acceptable Use Policy (Providers) and Marketing & Exposure Policy.

10. Limitation of Liability
10.1 JC Learning provides all services and content on an “as is” basis without warranties of any kind.
10.2 We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Platform.
10.3 Nothing in these Terms limits liability that cannot be excluded under applicable law.

11. Suspension or Termination
11.1 JC Learning may suspend or terminate any account that violates these Terms or any applicable policy.
11.2 We may also remove or disable content breaching these Terms without prior notice.
11.3 Termination does not affect rights accrued before the date of termination.

12. Links to Third-Party Sites
12.1 The Platform may contain links to third-party websites or services.
12.2 JC Learning is not responsible for the content, privacy practices, or reliability of external sites.
12.3 Accessing third-party sites is at your own risk.

13. Updates
13.1 JC Learning may update these Terms from time to time.
13.2 Material changes will be notified in advance via the Platform.
13.3 The latest version is always available at JC’s Legal & Policy Center.

14. Governing Law
14.1 These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR).
14.2 Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
